Terms of sale

These terms apply when you buy an Input.Observer license, a license upgrade, or styles from this website. Using the software is covered by the Input.Observer End User License Agreement ("the license agreement"), which you accept when you install it.

1. Who you are buying from​

Input.Observer is software by Robert Yapchanyk, an individual doing business in the United States ("we", "us"). Our address is 2219 Tomberlin Grove Ln, Plant City, FL 33566, USA, and you can reach us at [email protected].

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: Paddle runs the checkout, takes your payment, charges and pays any sales tax or VAT, and issues your receipt. Paddle's buyer terms apply to the payment. We are responsible for the software, your license key and your styles.

2. What you can buy​

  • A license. A license lets one named person use one major version of Input.Observer (for example, every 1.x release) on any number of computers that person uses, for personal or commercial purposes, with no time limit. An organization buys one license for each person who uses the software. The license agreement sets out exactly what the license allows.
  • An upgrade. An upgrade turns a license for an earlier major version into a license for the current one.
  • Styles. A style changes how Input.Observer draws your gestures. A style you buy is tied to the email address your license is registered to: it works in any copy of Input.Observer licensed to that address, including under the license keys of later major versions. Styles need a valid license. A trial copy doesn't unlock them.

Every license and style is a one-time purchase. Nothing renews, and nothing is charged again.

3. Prices and taxes​

Prices on this website are in US dollars and include tax. At checkout, Paddle shows and charges the price in your currency where it can, and works out the tax for where you live. The total Paddle shows before you pay is the total you pay.

An order needs a list-price total of at least US$5. A license or an upgrade meets that on its own.

4. Delivery​

Your license key and any purchase file for your styles appear on screen as soon as your payment is confirmed, and we email them to the address you gave at checkout. Keep that email: it is your record of the purchase. If you lose your key or your purchase file, write to us and we'll send it again.

The license key is registered to the email address you entered at checkout, or to the license email you confirmed for a styles order. It can't be moved to a different address.

5. Try before you buy​

Input.Observer has a free 30-day trial with every feature. Please use it to make sure the software works for you, on your computers and with the programs you use, before you buy.

6. Refunds​

You can get a full refund within 14 days of your purchase. Our refund policy explains how, and what a refund changes.

7. Updates​

A license includes every update we release for its major version. We aren't obliged to release updates, and a new major version is a separate purchase (at the upgrade price, for an earlier license).

8. Your rights as a consumer​

Nothing in these terms limits rights you have as a consumer under the law where you live that can't be excluded by contract. The warranty and liability terms for the software are in the license agreement.

9. Governing law​

These terms are governed by the laws of the State of Florida, USA, and applicable United States federal law, without regard to conflict-of-law rules. The state courts located in Hillsborough County, Florida, and the United States District Court for the Middle District of Florida, Tampa Division, decide any dispute about them, except where the law gives you, as a consumer, the right to bring a claim in the courts where you live.

10. Changes​

We may update these terms. The terms that apply to a purchase are the ones published on the day you made it.
